- IF YOU ARE A CLIENT OF HERZ LAWYERS
When you provide legal services, which data do you use, for what purpose do you use this data, and how long do you store it?
Herz Lawyers provides legal services. It requires compliance with applicable laws (information and/or documents regarding the identity of clients). In the course of providing legal services and when required by legal obligations, we process the following personal data of our clients:
Name, company name, contact details, telephone number, date and place of birth, residence for tax purposes, tax identification number, passport copies, excerpts from trade registers – for the purpose to identify you, to contact you, to provide you legal services, to send invoices. |
When you digitally sign documents as part of our legal services, we collect your email address, IP address, a signature image, and the date and time of signing. This information is stored within the relevant matter file to document the signing process. We retain this information based on our legitimate interest in maintaining evidence of the signature.
In general, we retain your personal data for the purposes outlined above for 20 years after the end of our client relationship or the relevant matter. Additionally, we store this data to facilitate potential audits by the Netherlands Bar Association, as we may be legally required to provide this information in the future.

- IF YOU ARE A VISITOR OF OUR OFFICE
When I visit your office, which data do you use, for what purpose do you use this data, and how long do you store it?
When you visit our office in Utrecht, you may appear on camera footage outside the premises of our Utrecht office. In case of guard the office, protect the safety and health of one or more natural persons, secure access to the office building, monitor incidents, we may process this data on the basis of our legitimate interest to do so.
When you attend a meeting at our offices, we record your name, company name, email address, entry and exit times, meeting date and time, and your contact person at Herz Lawyers. This information is stored in a system provided by Google Calendar. We collect this data based on our legitimate interest in planning and scheduling meetings, checking who is present for meetings, and ensuring internal control and security.
We retain this personal data for 3 months after your visit.

If you have provided your business card or otherwise shared your contact details with Herz Lawyers or one of its partners or employees, we will process personal data such as your name, contact details, company, position, and your contact person at Herz Lawyers.
We use your contact details to communicate with you, which may include reaching out to ask if you would like to receive updates from us. If you provided your contact details for a specific purpose, such as requesting information about our firm or a particular matter, we will use your information to fulfill that request.
We process your personal data based on either your consent (by voluntarily providing your contact information for a specific purpose) or our legitimate interest.

- IF YOU PROVIDE GOODS OR SERVICES TO HERZ LAWYERS
When I provide goods or services to Herz Lawyers, which data do you use, for what purpose do you use this data, and how long do you store it?
When you or your employer does business with us, we collect certain information about you. This often includes details you provide, like your name, email, and position. We may also gather information from order documents, such as the services or goods provided and payment details. Occasionally, we may request additional information, like a certificate of conduct. If you’re a freelancer, we will also store your contract with us.
We use this information to process and manage invoices, attribute costs to matters for billing clients, prepare balance sheets and profit-and-loss summaries, file tax returns, generate internal financial reports, and facilitate audits by an accountant.
Our reasons for processing this information are to fulfill our contract with you, to support our interest in charging clients for services, to comply with legal requirements and to maintain financial records, to comply with legal obligations.
We retain invoices and supplier contracts, including supplier contact information, for a minimum of seven years.
- IF YOU WANT TO APPLY OR HAVE APPLIED FOR A JOB AT HERZ LAWYERS
In the context of your application at Herz Lawyers, we will process certain personal data relating to you. You will provide us most of these personal data yourself, for example your personal contact details and your curriculum vitae.
We process the following personal data:
Name, address, telephone number, e-mail, language, nationality, civil status, family status gender, photograph, education, competence, professional experience, outcomes of personality – for the purpose to identify and correctly address you, to determine whether you are suitable for and meet all relevant requirements for fulfilling the position you applied for. |
We process these personal data in order to take steps at the request of a data subject prior to entering into a contract. Further, considering the nature of our services, we have legitimate interests to process this personal data in order to ensure that we hire competent and honorable personnel and to deal with possible complaints or claims relating to our application and selection procedure.
Your personal data will be kept during our application and selection procedure and will be kept for 4 weeks after completion thereof, unless the applicant has indicated that the data may be kept for a longer period of time.
- HOW DO YOU SHARE MY DATA OUTSIDE THE EU?
Herz Lawyers will not transfer your personal data to a company or establishment in a country outside the European Union unless a transfer agreement has been concluded. - DO YOU USE MY DATA FOR OTHER PURPOSES?
Herz Lawyers may also process some of the personal data mentioned above for the following purposes: to fulfill legal obligations, to investigate, establish, exercise, or defend against legal claims, and to prepare for or facilitate a sale, merger, or other transaction involving the assets of Herz Lawyers.
For fulfilling legal obligations, our legal basis is our duty to comply with these requirements. For the remaining purposes, our legal basis is our legitimate interest in conducting these activities.
- HOW DO YOU SECURE MY DATA?
Herz Lawyers implements appropriate (i) organizational and (ii) technical measures to protect your personal data against unlawful processing, theft, damage, destruction and/or loss.
Organizational measures taken include security clearances and limiting access to a “need-to-know” basis. Not all personnel at Herz Lawyers have access to your personal data. Organizational measures also include confidentiality provisions, screening of personnel, implementing controls in contracts with suppliers.
Technological measures include the use of passwords, encryption of laptops, phones and USB sticks, firewalls, network segmentation, virus scanners, traffic monitoring.
- YOUR RIGHTS

Right of Access. You have the right to request access to your personal data processed by or on behalf of Herz Lawyers, and further, where reasonably possible, access to the information listed in this Privacy Statement above.
Right to Rectification, Erasure, and Restriction. If your personal data is incorrect, incomplete, or not processed in compliance with this Privacy Statement, you have the right to have your personal data rectified, deleted or the processing thereof restricted (as appropriate).
Right to Object. You have the right to object including to the processing of your personal data on the basis of compelling grounds related to your particular situation, unless Herz Lawyers can demonstrate a prevailing legitimate interest for the processing.
Right to Transmit. You have the right to transmit your personal data directly to another controller without hindrance.

(i) to know whether or not we process your personal data and have access to your personal data and, if so, want to request access to your personal data;
(ii) to rectify your personal data;
(iii) to erase your personal data;

We will review whether your request is in line with data protection laws and handle your request accordingly. We will provide information on the actions taken without undue delay and in any event within one month of receipt of the request.
That period may be extended by two further months where necessary, taking into account the complexity and number of the requests. We shall inform you of any such extension within one month of receipt of Your request, together with the reasons for the delay.
If we base the processing of your personal data on your consent, you have the right to withdraw your consent at any time. However, this will not affect the lawfulness of the processing before the withdrawal of consent.
